Grievance and Appeals Process

 The method of appeal from a decision of the director of DSD for a student requested auxiliary aid or service, academic adjustment, accommodation, or disability determination is as follows:

Within seven (7) calendar days after receipt of the decision of Disabled Student Development, the student may request in writing the appellate review by the Associate Vice President of Student Affairs or his or her designee. The request to the Associate Vice President of Student Affairs shall be in writing, and shall include a brief statement of the grounds for appeal. The grounds for appeal shall be that:

    -There was substantial failure by the director of Disabled Student Development to comply with these procedures so as to deny a fair review of the request, or

    -The decision of the director of Disabled Student Development was not supported by the evidence.

    -The appellate review will be based on the information and materials in the case file, the director of Disabled Student Development findings and recommendations, and the student's written request for an appellate review.

    -The Associate Vice President of Student Affairs may affirm, modify, or reverse the decision of the director of Disabled Student Development, or at his or her discretion, refer the matter to the director of Disabled Student Development for further review and decision. The Associate Vice President of Student Affairs shall notify the student in writing of his or her decision within fifteen (15) calendar days after the appeal is received. The decision of the Associate Vice President of Student Affairs shall be final and not subject to further review.              

Students are encouraged to consult the Student Code of Rights and Responsibilities regarding other applicable procedures.

If you feel as though you have been discriminated against because of disability, the appropriate office to contact is the University Compliance Office. This office investigates all complaints of discrimination at the University. Or, you may contact the Office for Civil Rights (OCR) in the U.S. Department of Education. OCR is responsible for enforcing Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act.
