Guidelines for Copyright Compliance

The Guidelines for Copyright Compliance offers guidelines for the proper and legal use of others' copyrighted materials, be they printed, electronic, or visual, at Ball State University. However, these guidelines are simply that--guidelines. Whether a given use is permissible will be determined on a case-by-case basis, taking into account certain factors. These factors serve as the foundation for this document. By following its provisions, students, faculty, profession personnel, and other employees will likely be able to demonstrate that a particular use is permissible.

These Guidelines for Copyright Compliance are not to be confused with the University Copyright Policy, which governs those original works of authorship created by Ball State faculty, professional personnel, and students. That document is found in the Faculty and Professional Personnel Handbook and articulates procedures enacted by the Ball State University Faculty Senate and approved by the Board of Trustees. The Guidelines for Copyright Compliance serve to provide guidance regarding practices acceptable to Ball State for academicians as their needs relate to United States Copyright Law.

It is the policy of Ball State University to respect the ownership of all intellectual property governed under copyright laws and guidelines. By doing this, faculty, other employees, students and those authors of creative material external to this institution are encouraged to continue to produce high quality, original works. The following information provides the scope and means by which Ball State University endeavors to protect the rights of authorship.

The complete Guidelines for Copyright Compliance are also available in printed form at departmental offices, University Media Services, Information Technology Services, the VIS office, and at the University Libraries' Educational Resources Center.  It is also on permanent reserve at Bracken's Periodical/Reserves/Microforms counter, and available at the Office of Academic Research and Sponsored Programs. It is also accessible on the Videotex (VTX) online system located within the University's VAX computer system.
